1. About BrainRamp

These Terms are between you and BrainRamp, the provider of the tutoring service.

2. Agreement and eligibility

These Terms apply when you create an account, agree a tutoring arrangement, book a lesson, or use the BrainRamp portal. The Privacy Policy and Cookie Notice explain how personal data and cookies are handled.

The person accepting these Terms must be at least 18 and legally able to enter a contract. If the student is under 18, a parent or legal guardian must accept these Terms, authorise the tutoring, and supervise the student's use of the service as appropriate.

If you provide information for another person, including a child, you confirm that you have authority to do so and that the information is accurate.

3. The tutoring service

BrainRamp provides live, one-to-one Maths and Computer Science tutoring, normally through Google Meet. Standard lessons are 60 minutes unless another duration is agreed. Subjects, curriculum, schedule, rate, and learning priorities are agreed directly with the student or parent.

A free trial may be offered to assess fit. Unless BrainRamp expressly agrees otherwise, one trial is available per student and it has no cash value.

BrainRamp will provide the service with reasonable care and skill. Tutoring supports learning but does not guarantee a particular grade, examination result, admission outcome, or rate of progress. The student remains responsible for participation, independent study, school requirements, and examination rules.

4. Accounts and information

You must provide complete and accurate information, keep contact and timezone details current, and use the portal only for its intended purpose. Login links and account access must not be shared with unauthorised people.

Tell BrainRamp promptly if you suspect unauthorised account access. BrainRamp may take reasonable steps to verify identity before changing account details or responding to a data request.

5. Fees, invoices, and payment

The hourly fee and currency are discussed and agreed before paid lessons begin. The agreed fee appears in the account and on invoices. BrainRamp may propose a future fee change, but it will not apply retrospectively and will be communicated before affected lessons are booked or delivered.

Invoices identify the lessons supplied and are normally due within 14 days of issue. Payment is made by bank transfer using the currency and details shown on the invoice. You are responsible for bank charges or conversion costs imposed by your payment provider.

If an invoice is overdue, BrainRamp may send reminders and, after reasonable notice, pause new bookings or lessons. Any collection costs or statutory interest will be claimed only where permitted by applicable law. You should contact BrainRamp promptly if an invoice appears incorrect.

Nothing in these Terms limits mandatory consumer rights relating to price information, invoicing, or remedies for a service that is not provided with reasonable care and skill.

6. Booking, rescheduling, and cancellation

Portal bookings are subject to tutor availability. Students and parents can normally book available slots at least 6 hours in advance and up to 28 days ahead. Times are displayed using the account timezone.

A rescheduling request is not confirmed until BrainRamp approves it or a replacement lesson appears as confirmed. Until then, the original lesson remains scheduled. Alternative slots can become unavailable.

If you need to cancel, contact BrainRamp as soon as reasonably possible. Any cancellation or no-show charge must have been clearly disclosed and agreed before it applies. BrainRamp may reschedule or cancel a lesson because of illness, technical failure, or another reasonable cause and will offer a replacement or appropriate credit for a paid lesson it cannot provide.

7. EU consumer right of withdrawal

If you are an EU consumer entering a distance contract, you will generally have 14 days from the day the service contract is concluded to withdraw without giving a reason. To exercise that right, send a clear statement to noreply@brainramp.org identifying the account and the decision to withdraw.

If you book or ask BrainRamp to provide a lesson during the 14-day period, that request is an express request for performance to begin. If you then withdraw after a paid lesson has been supplied, BrainRamp may charge a proportionate amount for the service already provided. The withdrawal right may end once the service has been fully performed, where the law permits and the required prior consent and acknowledgement have been given.

This section does not remove any cancellation, refund, or consumer right that cannot legally be excluded.

8. Lesson conduct and safeguarding

Students, parents, and tutors must communicate respectfully and must not use the service for harassment, unlawful activity, cheating, impersonation, or sharing harmful material. BrainRamp may end a lesson or restrict access where reasonably necessary for safety, integrity, or legal compliance.

Lessons must not be audio- or video-recorded by any participant unless everyone affected has agreed beforehand. A parent or guardian remains responsible for the student's physical environment, device access, and appropriate supervision.

9. Learning materials, intellectual property, and reviews

BrainRamp or its licensors retain rights in original lesson materials, explanations, worksheets, and portal content. Students may use materials supplied to them for their own private study. They may not sell, publish, redistribute, or commercially exploit them without written permission.

School, examination-board, software, and third-party materials remain subject to their owners' rights and licences.

Reviews and comments submitted through the portal must be honest and lawful. Submitting private feedback does not give BrainRamp permission to publish the student's or parent's name, words, or identifying details as a public testimonial. Separate permission will be requested before publication.

10. Website availability and third-party services

BrainRamp aims to keep the website and portal available but does not promise uninterrupted access. Maintenance, internet outages, provider incidents, or events outside reasonable control may temporarily affect the service.

Google Meet, Google sign-in, email delivery, hosting, and banking services are provided by third parties and may also be subject to their terms. BrainRamp remains responsible for its own obligations but is not responsible for a third party's independent service beyond what applicable law requires.

11. Pausing or ending the service

You may stop booking lessons or ask BrainRamp to close an account by contacting Raksha Sadashiva Reddy. Amounts properly due for lessons already provided remain payable, and some records must be retained for legal purposes as explained in the Privacy Policy.

BrainRamp may pause or end the service for serious or repeated breach of these Terms, non-payment after reasonable notice, safety concerns, unlawful use, or where continuing the service is no longer reasonably possible. Where practical, BrainRamp will explain the reason and allow a reasonable opportunity to resolve a remediable issue.

12. Responsibility and liability

BrainRamp is responsible for foreseeable loss caused by its failure to provide the service with reasonable care and skill or by another breach of these Terms. BrainRamp is not responsible for loss caused by inaccurate information supplied by the user, failure to attend or participate, school or examination decisions, or events outside its reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

13. Governing law, jurisdiction, complaints, and changes

These Terms and any non-contractual obligations arising from them are governed by Dutch law. Subject to mandatory jurisdiction rules that cannot lawfully be excluded, the courts of the Netherlands have exclusive jurisdiction over any dispute arising from or connected with the service or these Terms.

BrainRamp may update these Terms to reflect service or legal changes. Material changes affecting an existing tutoring arrangement will be communicated in advance where reasonably possible. The version accepted when a lesson or arrangement was made will continue to govern that transaction unless a change is required by law or agreed with you.
